Former '90 Day Fiancé' star Michael Eloshway, currently serving a 10-year sentence for child pornography possession, has filed a motion to vacate his conviction, claiming his lawyer provided ineffective assistance.

In court documents filed this week, Eloshway argues that his trial counsel failed to hire a forensic digital expert to examine evidence collected from his computer, which he says prejudiced his case.

The reality TV personality also alleges that his lawyer mishandled jury selection and made other critical errors during the trial. This is not his first appeal; last year he argued his lawyer was ineffective for not asking jurors about their views on adult pornography.

Eloshway claims he accidentally downloaded child sexual abuse material while downloading large files of what he believed was adult pornography via BitTorrent. However, the court previously rejected this argument and upheld his 121-month sentence.

Eloshway gained fame on the first season of '90 Day Fiancé' in 2014, a show that follows couples navigating a 90-day visa process. His conviction shocked fans and highlighted the dark side of reality TV fame.

The court has yet to rule on the latest motion. If granted, Eloshway could receive a new trial; if denied, he will remain incarcerated until at least 2031.
